FDCPA and Reg F for Automated Collection Calls
Blog post from Retell AI
Automated AI debt-collection calls remain subject to the Fair Debt Collection Practices Act and Regulation F in the same way as human calls, with requirements governing disclosures, calling times, frequency, validation notices, third-party privacy, disputes, and cease-contact requests. Regulation F creates rebuttable presumptions of violation when collectors exceed seven calls about a particular debt in seven days or call again within seven days of a telephone conversation, while its rules are applied per debt rather than per consumer. AI may improve consistency by enforcing approved scripts, local-time calling windows, right-party verification, limited-content voicemails, and detailed call records, but configuration mistakes can be repeated at scale, making pre-launch testing and continuous monitoring essential. The Telephone Consumer Protection Act imposes separate technology-based rules because AI-generated voices are considered artificial voices, including consent requirements for wireless calls, a three-call limit in 30 days for certain residential-line calls without consent, identification requirements, and interactive opt-out mechanisms. State laws, account-specific circumstances, security reviews, and human escalation for complex matters such as disputes, settlements, hardship, or represented consumers also remain important, and legal counsel should review any collection-calling program.
