Data residency vs data sovereignty for AI agents
Blog post from Parallel Web Systems
Data residency concerns where data is stored and processed, while data sovereignty concerns the jurisdiction, ownership, and legal obligations governing access to that data; organizations should clarify which requirement applies before evaluating vendors. The GDPR does not generally require EU data to remain in the EU, permitting international transfers through mechanisms such as adequacy decisions and Standard Contractual Clauses, though contractual or sector-specific rules may still favor regional processing. European concerns about sovereignty are influenced by laws such as the US CLOUD Act and the evolving legal status of EU-US transfer frameworks following Schrems II. For AI agents, these issues extend beyond databases to every service involved, including model providers, search APIs, page extraction tools, and logging systems, since user-generated search queries may contain sensitive information. Parallel offers optional EU data residency for basic-mode Search API requests sent through its EU endpoint, where the endpoint, search index, and inference operate in the EU with no default retention, but it does not offer data sovereignty because Parallel is a US company; limited billing metadata is sent to the US, while live fetch operates globally and the Extract API is excluded.
