Vietnam’s Law 122/2025/QH15, effective from 1 July 2026, and implementing Decree 248/2026 establish identity-verification obligations for e-commerce sellers, livestream sellers, and affiliate marketers, with platforms or affiliate-link providers responsible for completing checks before these activities begin. From 1 January 2027, platforms must electronically verify sellers and livestream sellers, while foreign individuals and organizations are verified through lawful documents such as passports and registration certificates. Decree 320/2026 adds a requirement for relevant accounts to link with Vietnam’s electronic identification system, VNeID, effective from 28 September 2026, with many pre-existing accounts required to comply before 31 December 2026. Domestic business verification includes organization details and legal-representative information, while beneficial-owner information, including ownership or control of at least 25%, is relevant to company checks under updated enterprise rules. Platforms also face related responsibilities involving listing moderation, rapid account suspension upon official requests, licensing checks for conditional businesses, livestream recording retention, and certain tax-data obligations. The material recommends combining identity, business-registry, ownership, document, and risk-screening processes, while noting that VNeID linking must occur through approved electronic-authentication arrangements and cannot be replaced solely by conventional document or selfie checks.
