MiCA is the European Union’s comprehensive framework for regulating crypto-assets, intended to harmonize rules across member states, protect consumers, support innovation, improve transparency, and combat market abuse and money laundering. It broadly defines crypto-assets and divides them into asset-referenced tokens, electronic money tokens, and other assets such as utility tokens and decentralized cryptocurrencies, with stricter requirements for stablecoin issuers. Approved in April 2023 and published in June 2023, the regulation applies in phases, with stablecoin rules effective from June 2024 and requirements for crypto-asset service providers from December 2024, while Spain has set a transition deadline through December 2025. Businesses operating as crypto-asset service providers must obtain authorization, meet capital, governance, risk-management, transparency, consumer-protection, KYC, and AML obligations, with additional duties for trading platforms and custodians. Although compliance may require substantial operational changes, particularly for startups and smaller firms, MiCA is presented as a significant step toward a more secure, standardized, and competitive European crypto market.
