The Digital Operational Resilience Act (DORA) is an EU regulation aimed at enhancing the resilience of financial entities, such as banks, investment firms, insurance companies, and FinTechs, against ICT-related disruptions. DORA consolidates and harmonizes existing ICT regulatory requirements, establishing an EU-wide standard that emphasizes digital operational resilience, including ICT risk management, incident reporting, resilience testing, third-party risk management, and information sharing. This regulation extends to critical third-party ICT service providers, requiring them to meet stringent requirements to ensure the uninterrupted operation of financial services. For FinTechs, DORA mandates a comprehensive approach to managing ICT risks, particularly due to their reliance on technology and external service providers. Identity providers, in particular, are under increased scrutiny to ensure secure access and prevent unauthorized breaches. FinTechs must adopt a proactive strategy, integrating risk management into all stages of ICT systems' lifecycles, and implementing robust due diligence for third-party relationships to ensure compliance with DORA by its effective date of January 17, 2024. Failure to comply may result in substantial fines, emphasizing the importance of thorough preparation and ongoing oversight.
